1. The Agreement between us
1.1 We, the Forces Pension Society will sell and you, the customer, shall purchase the Products (defined below). These Conditions are intended to set out the agreement between us.
1.2 "The Products" means all items displayed on this website.
1.3 It is your responsibility to read these Conditions carefully and raise any problems with us before you place an order.
1.4 It is your responsibility to check that your order and the information you give us is accurate and complete and to give us all the information we need to complete the order. We will let you know what, if any, information we do need.
2. Price of the Products
2.1 The price of the Products and any delivery costs will be calculated, in pounds sterling, when you complete your order form and will be shown at the bottom of the order form.
2.2 The price calculated on the order form will include value added tax ("VAT") when applicable at the prevailing rate if the delivery address for the Products is within the European Union. If your address is outside the European Union, then VAT if applicable will not be charged, although local taxes and customs charges may be applicable and will be your responsibility.
2.3 All orders are subject to payment being received by us in full and of the availability of the Products. Please note that the acknowledgement of your order does not constitute a binding contract. A binding contract will only be formed once we have received payment and been informed that the Products are available. If payment is not received or Products are not available we will endeavour to notify you that your order cannot be processed.
2.4 Subject to our obligation to supply Products at the price stated in acknowledged orders, we reserve the right to increase the list prices of the Products at any time without notice. We may make changes in the Products and the prices described on this website and to the content of our website at any time without notice. We shall not be responsible for any detrimental reliance placed on this website or its contents.
2.5 If we discover an error in the price listed on our website we will inform you and give you the option to reconfirm your order at the correct price or to cancel the order.
3. Payment
3.1 Payment over the Internet can be made by Visa, Mastercard, Switch or Delta.
3.2 We welcome younger customers and encourage them to get their parents or guardians to buy the Products on their behalf. Unfortunately for legal reasons, orders are not accepted from people under the age of 18 or where older, who are still "minors" under their local law. However by placing an order you represented to us that you are over the age of 18 or where appropriate not a minor. Where you place an order and are under that age, you are in breach of these conditions and possibly otherwise in breach of the appropriate local law and further we are not therefore obliged to perform our obligations under that Order. The holder of the credit or debit card which you use will be fully liable for all sums so charged.
4. Delivery
4.1 Whilst we aim to deliver all orders within 14 days for the avoidance of doubt, there is no fixed delivery date but in any event, please allow at least 28 days for mainland UK only. Orders may be dispatched in more than one package and will not necessarily arrive at the same time. Please allow additional time for overseas orders.
4.2 If in the case of unforeseen circumstances beyond our reasonable control, we are not able to deliver your order within 28 working days mentioned above, we will contact you and you may cancel your order.
4.3 Any discrepancy between the products delivered pursuant to the order must be notified in writing to the Forces Pension Society within 14 days of delivery.
5. Our Responsibility
5.1 We will make every effort to ensure that the Products which we supply to you will be of satisfactory quality. If, once you have examined the Products, you discover a defect in the quality of the Products you must write or email us as soon as possible after discovering the defect.
5.2 If you notify us of a defect in the quality of the Products and as a result of the defect, those Products are not of satisfactory quality, we will replace the Products free of charge or, if you prefer you can return the Products to us we will refund to you the price which you have paid us for those Products.
5.3 All Products are subject to availability. We reserve the right to withdraw any Products from sale at any time and substitute them with similar Products of equal quality or price. If however you are not satisfied with the Products, we will replace the Products free of charge and the cost of returning such substituted Products will be borne by the Forces Pension Society.
6.Your Right to Cancel
6.1 If, at any time up to 7 working days after delivery of the Products, you decide that you would like to withdraw your order, then you will have the right to do so by informing us in writing or by email. We must receive your written notice withdrawing your order within the period referred to above. You must at your expense also immediately return the Products to us that were delivered to you in respect of that order.
6.2 If you do withdraw your order, we will repay any amounts paid by you to us in respect of that order within 30 days. You will be expected to pay any costs incurred in returning any Products to us where you have withdrawn an order in accordance with this Condition.
6.3 If you wish to reject the Products delivered to you because they are in some way faulty then please refer to our Returns Policy.
7. Things You Should Know
7.1 The Forces Pension Society is governed as a non-for-profit limited company; Company Number: 418311. It also works closely with a small charity called the FPS Charitable Fund. Its registered office is at 68 South Lambeth Road, Vauxhall, London SW8 1RL.
7.2 If, for some reason which is beyond either of our control, either of us are unable to comply with these Conditions, that party will not be liable to the other or be deemed to be in breach of the agreement between us. Such reasons shall include, but not be limited to, war, riots, fire, explosion, flood, insurrection, embargo, industrial action, shortage of transport, general shortage of material and acts or omissions of governments.
7.3 If on any occasion either of us agree to take no action against the other even after the other has failed to comply with these Conditions, that party should not assume that the other will do the same on another occasion.
7.4 If it becomes necessary for a court to enforce these Conditions and any one of these Conditions is found to be invalid or unenforceable this will not affect the remainder of the agreement between us.
7.5 Where there is a reference in these Conditions to "working days" this shall mean Monday to Friday inclusive but excluding any statutory or bank holiday in England.
7.6 A person who is not a party to the contract for the supply of the Product has no rights under the Contract's (Rights of Third Party) Act 1999 to enforce any forms of the contract but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
8. Privacy and Security
8.1 To make sure you always have the highest level of security, your payment details are automatically encrypted when you enter them.
8.2 We will store details of you and your order on our systems so that we can efficiently process your order. We may use these later to send you details of our Products and Offers. We sometimes pass your details to reputable third parties. If you do not want us to do this please email us quoting your name, address and preferably your order number.
8.3 A lot of information we receive from you when you access this website, such as the domain from which you access the Internet, the date and time you access this website, is not personally identifiable but will be used by us purely for monitoring activitiy on our website. You have the right under the Data Protection Act to request a copy of the personal data which we hold with reference to you and to request that we delete this information from our computer system.
8.4 We do not use "cookies" to track your navigational habits or to collect and distribute information to third parties for marketing purposes.
8.5 We (our website designer) have technological and operational procedures in place to protect this information from loss, misuse, alteration or destruction, and all of our employees are subject to strict obligations of confidentiality concerning all our data.

10. Governing Law and Jurisdiction
10.1 These Conditions and the agreement between us are subject to English law and the exclusive jurisdiction of the English courts, although if it becomes necessary for us to enforce any of our rights under these Conditions against you, we may do so in any relevant and competent court.
11.Terms of Use & Disclaimer
11.1 By using the Forces Pension Society website and/or by purchasing Products you agree to be bound by these Conditions.
11.2 The copyright in the contents and materials of this website is owned by the Forces Pension Society (or by the publishers of the sites to which these pages link).
11.3 Due to the nature of the electronic communication process, we cannot, nor do we guarantee or warrant, that access to our website (or any part of it) will be uninterrupted, or without delay and we accept no liability in this respect. Furthermore, whilst we make all reasonable attempts to exclude viruses from this website, we cannot ensure that it will be free from viruses and we cannot and do not accept any liability in this respect. You are therefore recommended to take all appropriate safeguards before downloading or accessing information from this website.
11.4 You are responsible for maintaining the confidentiality of your account details with us and for all uses of your account, whether or not expressly authorised by you.
RETURNS POLICY
The Forces Pension Society is committed to providing the highest quality products and order service to our orders. If you are not satisfied with your goods for any reason, we do operate a 14-day money back guarantee, subject to the follow guidelines:
1. If the products are the subject of any warranty or guarantee given by the manufacturers or suppliers of those products, we guarantee to you that such products will be free from defects caused by faulty materials or poor workmanship for the period of that warranty or guarantee. Under this warranty or guarantee we will, at our option, either repair or give a replacement of equivalent quality or issue credit to you for any products found to be defective. This is subject to:
(a) You notifying us in writing within 7 days of your first discovering the defect;
(b) The products having been used in an appropriate manner and/or as prescribed in the operating instructions (if any);
(c) You delivering the products to us, at your expense; and
(d) Us being satisfied that such defects exist and have not been caused by misuse, neglect, accident, improper storing, installation or handling or by repair or alteration not carried out by us.
(e) You will not be entitled to receive any compensation, credit or refund in excess of that received by us under any guarantee or warranty given to us by the manufacturer or supplier of that product.
2. Where the products are not the subject of any warranty or guarantee given by the manufacturers of those products and you wish to reject the products for whatever reason, then we will accept the return of the products provided that you return the products to us within 14 days of them being delivered to you. This is subject to:
(a) In the case of unwanted, all products returned must include all original packaging and documentation and must be returned in the same condition that they were despatched to you and must be unused. Any damage or loss to either the product, packaging or the documentation may affect the amount of refund made.
(b) Where you have ordered products in an incorrect size, colour or model and wish to exchange for the correct size, colour or model then, subject to the conditions in 2(a) above, we will exchange the products and deliver the exchanged product to you free of charge.
(c) Where the product you have ordered is defective then, subject to us being satisfied that such defect exists and has not been caused by incorrect use, storage or handling, we will credit you in full.
When sending a return, the parcel is your responsibility until it reaches us. This means you are also responsible for the postage for the return parcel. We strongly recommend that you send the parcel using a recorded delivery service. If you are returning an item as a result of a mistake by the Forces Pension Society, we will pay for the cost of postage for the return parcel. We do not accept liability for parcels damaged during transit so we advise you to wrap the product adequately to prevent this happening.
